Waivers
An owner of a covered building may seek a waiver from the benchmarking requirement set forth in House Bill 21-1286, if the owner submits documentation to, and receives approval from, the Colorado Energy Office.
If you believe your building qualifies for a waiver from Building Performance Colorado, you need to complete and submit this form by November 15, 2022. You may only submit one property per waiver form and one form per deadline year. Waiver reasons apply to the data collection year. If your waiver is approved, you will need to pay the $100 annual benchmarking fee, and then your building will be considered in compliance for the current reporting year and no further action is needed until the next reporting year.
Waivers are only valid for one reporting year.
Exemptions
If you believe your building is exempt from reporting to Building Performance Colorado, you need to complete and submit this form by November 1, 2022. You may only submit one property per exemption form. An approved exemption removes your building from the benchmarking requirements for that year, and are only applicable to buildings that meet the exact and specific reasons stated below and are proven with proper documentation.
Exemptions are only valid for one reporting year.
In order to be considered, you must use the link below to upload documentation that supports your claim of waiver or exemption. After the request is reviewed, you will receive an official email notification from Building Performance Colorado stating your request has been either approved or denied.
